The lecture comprises (1) the foundations of European Data Protection Law, including history and sources of European Data Protection Law, a strong focus on the new European Data Protection Regulation, including (2) general data protection principles, legal bases for the processing of personal data, and conditions for consent, (3) the new data subjects rights, including data access rights, right to be forgotten, right to data portability, and right to object, (4) data mapping requirements, privacy by design and default, data protection impact assessments, duties of data controllers and data processors, (5) requirements for international data transfers, adequacy decisions, Standard Contractual Clauses, Binding Corporate Rules, and the Privacy Shield, (6) requirements and tasks of the Data Protection Officer position, role and cooperation of Data Protection Authorities, remedies, liability and penalties, regulatory investigations and inquiries, data security requirements, data breaches and data breach notifications, International Data Protection Law, including (7) the Data Protection Laws of Switzerland, Germany, UK, and the US, and (8) the Data Protection Laws of Turkey, Russia, Brazil, Argentina, China and Australia.
This foundational part will be followed by practical sessions about (9) User Privacy Notices, User Cookie Notices, privacy compliant marketing and advertising technologies, tracking technologies and analytics, big data applications and payment technologies, (10) guidelines how to implement the European General Data Protection Regulation in a company, (11) data protection contracts between controllers and processors, including liability and indemnity clauses, (12) the handling of data incidents and data breaches, filing of data breach notifications, and the engagement with Data Protection Authorities.
After the described 12 sessions, the lecture will be closed (13) with an overall summary of the learnings, and a discussion about current trends and developments in the data protection field. |
